Purpose:
This policy defines the authorities for entering into any arbitration or mediation involving the University.

Policy:
Authority to bind the University to determinations of arbitration or mediation rests with the President as authorized by the Board of Trustees. The President, as directed by the Board, shall ensure that all contracts or agreements that require that conflict be resolved by arbitration or mediation are written to assure fair representation of the University’s interests, and shall ensure that all arbitration or mediation is conducted fairly and according to agreed principles.

All awards and settlements shall be paid according to the terms of the award or settlement from budgeted funds, upon the authorization of the Chair of the Board of Trustees. Awards or settlements that require payments in excess of budgeted amounts shall require budgeting action by the Board of Trustees prior to payment.
